Terms and Conditions

Welcome to Cordero Builders LLC. By engaging our services, you agree to the following Terms and Conditions. These terms govern all interactions between clients and Cordero Builders LLC (“Company”, “we”, “us”) for residential and commercial remodeling, new construction, and related services in Illinois.

Please read carefully. If you do not agree with any part of these Terms, you should not proceed with our services. By hiring or engaging us, you acknowledge that you understand and accept these Terms.

1.1     Services

1.1.1     Scope of Work

We provide residential and commercial remodeling, new construction, and related services as outlined in the proposal, contract, or quotation provided to the client. Services may include design consultation, materials procurement, labor, and project management.

1.1.2    Changes to Scope

Any changes or additions to the project scope must be documented in writing and signed by both parties. Additional work may incur extra charges.

1.1.3    Professional Standards

We commit to delivering services with reasonable care, skill, and diligence in accordance with industry standards. We are licensed and insured, and all work will comply with applicable building codes, regulations, and safety standards in Illinois.

1.2    Client Responsibilities

1.2.1    Access to Property

Clients must provide reasonable access to the property and ensure the work area is safe and clear of obstacles.

1.2.2    Accurate Information

Clients must provide accurate information regarding property dimensions, utility locations, and project requirements. Any errors or omissions may affect project scope and cost.

1.2.3   Decision Making

Clients are responsible for timely approvals, selections of finishes, colors, or materials, and responding to communications to prevent delays.

1.3    Payment Terms

1.3.1    Pricing and Estimates

All project estimates are based on the information available at the time of quotation. Final pricing may vary if additional work, materials, or unforeseen conditions arise.

1.3.2   Deposit

A deposit may be required before work commences, as outlined in the contract. The deposit is non-refundable once materials are ordered or work begins.

1.3.3   Progress Payments

For multi-stage projects, progress payments may be requested at agreed milestones. Failure to pay on schedule may result in suspension of work.

1.3.4   Final Payment

Final payment is due upon completion and prior to project handover. Completion is defined as the work meeting contract specifications and passing any required inspections.

1.4    Warranties and Liability

1.4.1    Workmanship Warranty

We provide a limited workmanship warranty for our services as specified in the contract. This warranty does not cover normal wear, misuse, or damage caused by the client or third parties.

1.4.2   Material Warranties

Materials supplied by Cordero Builders are subject to manufacturer warranties, which we will provide to the client upon request.

1.4.3   Limitation of Liability

Except where prohibited by law, Cordero Builders’ liability is limited to the total fees paid by the client for the specific project. We are not liable for indirect, incidental, or consequential damages.

1.5    Delays and Force Majeure

1.5.1    Project Delays

We strive to meet agreed timelines. However, delays caused by weather, material availability, or client changes are not the responsibility of Cordero Builders.

1.5.2   Force Majeure

Neither party is liable for delays or failures caused by events beyond reasonable control, including natural disasters, strikes, pandemics, or government actions.

1.6    Termination

1.6.1    Termination by Client

Clients may terminate the contract in writing. Termination may result in charges for work performed, materials ordered, and any associated costs.

1.6.2   Termination by Company

Cordero Builders reserves the right to terminate the contract if the client fails to meet obligations, including payment delays, unsafe work conditions, or breach of terms.

1.6.3   Return of Materials

Upon termination, clients are responsible for reimbursing the Company for any non-refundable materials or third-party costs incurred.

1.7    Intellectual Property

All designs, drawings, plans, and project-related materials remain the intellectual property of Cordero Builders unless explicitly transferred in writing. Clients may use them only for the agreed project. Unauthorized use or reproduction is prohibited.

1.8    Dispute Resolution

1.8.1    Negotiation

Both parties agree to attempt to resolve disputes amicably through direct negotiation.

1.8.2   Mediation / Arbitration

If negotiation fails, disputes may be submitted to mediation or binding arbitration in Illinois in accordance with state laws.

1.8.3   Governing Law

These Terms are governed by the laws of the State of Illinois. Any legal action must be brought in courts located within Illinois.

1.9    Privacy and Data Protection

We respect your privacy. Any personal data collected during the project will be used solely for project management, billing, and communications. We do not share client data with third parties except where required by law or necessary for project completion.

1.10 Miscellaneous

  • Severability: If any provision is deemed unenforceable, the remaining terms remain valid.
  • Entire Agreement: These Terms and Conditions, along with the contract and proposal, constitute the full agreement between the client and Cordero Builders.
  • Amendments: Any amendments must be documented in writing and signed by both parties.
  • Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
